- De Tweeling may change the prices of its services and products on its website and in other communications at any time.
- Increases in the cost prices of products or parts thereof, which De Tweeling could not reasonably foresee at the time of making the offer or concluding the agreement, may result in price increases.

Article 4 – Samples and Models
- If the Customer has received a sample or model of a product, no rights may be derived from it other than that it is an indication of the nature of the product, unless it has been agreed in writing that the products to be delivered will correspond to the sample or model.

- De Tweeling may require an advance payment of up to 50% of the agreed amount when entering into the agreement.
- Payments made after delivery must be settled within 14 days after delivery.

- De Tweeling may make delivery conditional upon immediate payment or require adequate security for the total amount of the services or products.

- Before ownership has passed to the Customer, the Customer may not pledge, sell, transfer, or otherwise encumber the products.

- Delivery takes place at De Tweeling, unless agreed otherwise.
- Delivery of online ordered products takes place at the address provided by the Customer.

- If the Customer arranges transport themselves, any visible damage to products or packaging must be reported to De Tweeling prior to transport. Failure to do so releases De Tweeling from liability.
Article 19 – Storage
- If the Customer collects ordered products later than the agreed delivery date, the risk of any quality loss rests entirely with the Customer.
- Any additional costs resulting from early or late collection of products are borne entirely by the Customer.
Article 20 – Assembly and/or Installation
- Although De Tweeling strives to carry out assembly and/or installation work to the best of its ability, it accepts no responsibility except in cases of intent or gross negligence.
Article 21 – Warranty
- Warranty applies only to defects caused by faulty manufacturing, construction, or defective materials.
- The warranty does not apply:
– in the case of normal wear and tear
– for damage caused by accidents;
– for damage caused by modifications made to the product
– for damage resulting from negligence or improper use by the Customer
– if the cause of the defect cannot be clearly established - The risk of loss, damage, or theft of products subject to an agreement between the Parties transfers to the Customer at the moment the products are legally and/or physically delivered or come under the control of the Customer or a third party receiving them on behalf of the Customer.

- If De Tweeling is liable for damage, this liability is limited to direct damage related to the performance of the underlying agreement.
- De Tweeling is not liable for indirect damage, such as consequential damage, loss of profit, or damage to third parties.
- If De Tweeling is liable, such liability is limited to the amount paid out under any applicable (professional) liability insurance. If no insurance exists or no payment is made, liability is limited to the (portion of the) invoice amount to which the liability relates.
- All images, photos, colors, drawings, and descriptions on the website or in a catalogue are indicative only and cannot give rise to compensation, termination, or suspension.
Article 27 – Limitation Period
- Any right of the Customer to claim compensation from De Tweeling expires 12 months after the event from which the liability arises, directly or indirectly. This does not exclude the provisions of Article 6:89 of the Dutch Civil Code.
Article 28 – Termination
- The Customer may terminate the agreement if De Tweeling culpably fails to fulfill its obligations, unless such failure does not justify termination due to its special nature or minor significance.
- If performance by De Tweeling is still possible, termination may only take place after De Tweeling is in default.
- De Tweeling may terminate the agreement if the Customer fails to fulfill its obligations fully or in a timely manner, or if De Tweeling has reasonable grounds to assume that the Customer will not fulfill its obligations.
Article 29 – Force Majeure
- In addition to Article 6:75 of the Dutch Civil Code, a failure by De Tweeling cannot be attributed to De Tweeling if there is a force majeure situation.
